digui

Terms and Conditions

These terms are the agreement between you and [COMPANY LEGAL NAME] for using Digui, the AI phone receptionist at digui.ai. By using the demo or creating an account, you accept them.

The service

Digui builds an AI receptionist from a business's website. It answers calls in the browser and, on a paid plan, the business's own phone calls once they're forwarded to Digui's line. It can look things up in documents you add, use apps you connect, and chat on your website.

We keep improving Digui, so features may change. If we remove something important from a paid plan, we'll tell you first.

Who can use Digui

Digui is for businesses. You must be 18 or older, and if you use it for a business, you confirm you're allowed to accept these terms for it: then "you" also means the business.

Your account

  • Give us accurate information, and keep your sign-in safe.
  • You're responsible for what's done with your account.
  • If you think someone else is using it, change your password and write to [CONTACT EMAIL].

The free demo

  • Anyone can type a website, get a receptionist built from it, and call it in the browser, for free.
  • Anyone with a receptionist's link can open it and call it. Don't share one that knows something private.
  • You may try the demo with any public website, but you may not use a receptionist built from a business you don't represent to pose as that business or mislead anyone.
  • Demo calls end after 5 minutes, and how many receptionists and calls anyone can make is limited. We may change or stop the demo at any time.

Plans

Free, Starter, Professional and Business, with what each includes (receptionists, minutes, tools) on our plans. Free is the demo, with calls in the browser. Installing a receptionist on your business's phone needs a paid plan, and tools need Professional or Business.

An upgrade starts right away, for what the checkout shows. A downgrade starts when the month you paid for ends. Receptionists past your new plan's number stay, but you can't add more, and tools stay saved but your receptionists stop using them below Professional.

Billing and renewals

  • Prices are in US dollars, per month, paid in advance by card. Clerk Billing runs the checkout and Stripe processes the payment.
  • Paid plans renew every month, charged to your card, until you cancel.
  • If we change a plan's price, we tell you first, and the new price applies from your next renewal after that.
  • If a payment fails, update your card in Manage account › Plan › Payment method and invoices. If it can't be collected, your account can move to Free.

Minutes and extra minutes

  • Each plan includes so many minutes of calls a month, counted from the start of the month you paid for.
  • Minutes count your receptionists' calls, on the phone and in the browser. A deleted receptionist's calls still count that month. Website chats and the time a call spends transferred to your team don't.
  • On a paid plan, each minute past those included costs $0.25. Usage shows how many you've used and what they cost, and we may charge them to your card.

Cancelling

Manage account › Plan › Cancel plan. Your plan keeps working until the month you paid for ends, then your account moves to Free. Changed your mind before then? Press Keep my plan. See how to cancel.

Cancelling doesn't refund the month already paid, unless the law requires it.

Acceptable use

Don't use Digui to:

  • Break any law, including telemarketing, consumer protection, privacy and call recording laws.
  • Send spam, harass anyone, or make unwanted calls or messages.
  • Pose as a person or business you don't represent, or mislead callers about who they're talking to.
  • Collect payment card numbers, passwords, or health information that needs a business associate agreement (as under HIPAA), unless we've agreed to it in writing.
  • Upload content you have no right to use, or that's illegal, defamatory or hateful.
  • Get around Digui's limits, reach other accounts' data, overload or break Digui, or copy it.

Telling your callers

Some laws require telling callers that they're talking with an AI, or that the call is recorded or transcribed, or getting their consent. If yours do, you must do it: for example, in your receptionist's greeting, which you can edit on the dashboard.

Your content and your callers' data

  • You're responsible for what you give Digui (your website, documents, prompts, greetings and instructions): that it's accurate, legal, and yours to use.
  • You let us use it to provide Digui to you, for example to send it to the providers that run your calls.
  • For your callers' data, you're the controller: you need a legal basis to collect it, you tell them how you use it, and you answer their requests. We process it for you, as our Privacy Policy explains.
  • If your law requires a data processing agreement with us, write to [CONTACT EMAIL].

AI can make mistakes

  • Your receptionist writes its replies with AI. It can mishear, misunderstand, give a wrong or incomplete answer, or book the wrong time. Check your Logs, and correct its prompt and documents when it gets something wrong.
  • It doesn't give professional advice: nothing it says is medical, legal, financial or other professional advice.
  • It isn't an emergency service. Don't forward an emergency line to it.
  • You're responsible for what it tells your callers on your behalf, and for what you decide from what it does.

Availability

We work to keep Digui running, but we can't promise it never stops or never drops a call. It depends on other services (phone carriers, Twilio, ElevenLabs, AI models) and on your phone's call forwarding. Keep another way for your customers to reach you.

Other companies' services

Digui runs on, and connects to, other companies' services: Clerk, Stripe, Pipedream, Google Calendar, Gmail, Outlook, Calendly, Shopify, Square and others. Their own terms apply to your use of them, and we're not responsible for them. Calendly booking, for example, needs a paid Calendly plan.

Intellectual property

Digui, its software, its site and its name belong to [COMPANY LEGAL NAME]. You keep what's yours: your content and your callers' data. If you send us ideas or feedback, we may use them freely.

Limits of liability

  • As far as the law allows, Digui is provided as is and as available, without warranties of any kind.
  • We're not liable for indirect or consequential losses, like lost profits, revenue, data or customers, including from missed or mishandled calls or bookings.
  • Our total liability for any claim is limited to what you paid us for Digui in the 12 months before what caused it.
  • You'll cover our losses from claims by your callers or others about your content, how you used Digui against these terms, or how you handled your callers' data.
  • Nothing here limits what the law doesn't allow to be limited, or your rights as a consumer where they apply.

Suspension and termination

  • You can stop using Digui at any time: cancel your plan, and to delete your account, write to [CONTACT EMAIL].
  • We may suspend or close an account that breaks these terms, doesn't pay, or puts callers, Digui or others at risk. We tell you first when we reasonably can.
  • When an account closes, its receptionists stop answering, and we delete its data as our Privacy Policy says. What these terms say about payments, your content, liability and the law keeps applying.

Governing law

These terms are governed by the laws of [COUNTRY], and disputes go to its courts, unless the law where you live gives you the right to go to your own.

Changes to these terms

We may update these terms; this page shows the date of the latest version. If a change matters, we tell account holders by email or in the dashboard before it applies. Using Digui after that means you accept it; if you don't, cancel your plan.
